1. Acceptance of Terms
By accessing or using Lurko ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Lurko.
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
2. Description of Service
Lurko is a SaaS platform that monitors online communities (Reddit, Hacker News, IndieHackers, YouTube) to identify conversations relevant to your product. The Service uses AI to score the relevance of conversations and generate draft replies tailored to each platform's tone and rules.
Important: The Service does not post content on your behalf. You are solely responsible for reviewing, modifying (if desired), and manually posting any replies generated by the Service. Lurko is a tool that assists you — it does not act on your behalf.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the accuracy of your account information
- Keeping your login credentials secure and confidential
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you meet this requirement.
4. Free Trial and Subscription
New accounts receive a free 7-day trial with up to 50 AI-generated drafts. No credit card is required to start the trial. After the trial period:
- Continued use of the Service requires a paid subscription
- Subscription plans are billed monthly
- Draft quotas renew on your subscription anniversary date (not the 1st of the month)
- Unused drafts do not roll over to the next billing period

5. Acceptable Use
You agree to use the Service responsibly and in compliance with all applicable laws. Specifically, you agree to:
- Respect platform rules: Use generated replies in compliance with each platform's terms of service, community guidelines, and subreddit rules
- No spam: Do not use the Service to generate bulk, repetitive, or low-quality responses across multiple threads
- No deception: Do not misrepresent AI-generated content as solely your own original thought when platform rules require disclosure
- No circumvention: Do not attempt to bypass usage quotas, rate limits, or other technical restrictions
- No reverse engineering: Do not copy, decompile, disassemble, or attempt to derive the source code of the Service
- No harassment: Do not use the Service to target, harass, or intimidate individuals
Violation of these terms may result in immediate account termination without refund. We reserve the right to determine, in our sole discretion, whether conduct violates these terms.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of all data you provide to the Service, including your product URL, Brand Brain edits, and any modifications you make to generated drafts. You grant us a limited license to use this data solely to provide and improve the Service.
6.2 Generated Content
Draft replies generated by the Service are licensed to you for unrestricted use. You may copy, modify, and post them on any platform without attribution to Lurko OS. We do not claim ownership of generated drafts.
6.3 Our Intellectual Property
Lurko, including its platform, algorithms, Brand Brain technology, user interface, and documentation, is owned by us and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
7. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for:
- Consequences of posting generated replies on third-party platforms
- Account bans, penalties, or restrictions imposed by third-party platforms
- Accuracy, completeness, or appropriateness of AI-generated content
- Service interruptions, downtime, or data loss
- Indirect, incidental, consequential, or punitive damages
Our total aggregate liability under these Terms shall not exceed the total amount you paid to us in the 12 months preceding the event giving rise to the claim.
8. Cancellation and Refunds
You may cancel your subscription at any time from Settings > Account. Upon cancellation:
- Your subscription remains active until the end of the current billing period
- No refunds are provided for partial months or unused drafts
- Your data is retained for 30 days after the subscription expires, then permanently deleted
- You can reactivate your account within the 30-day grace period without data loss
To delete your account and all data immediately (GDPR right to erasure), use the "Delete my account" option in Settings > Account. This action is irreversible and removes all data including projects, Brand Brains, threads, drafts, and analytics.
9. Modifications
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email before the changes take effect. For minor clarifications or non-material changes, we may update the Terms with immediate effect.
Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and cancel your subscription.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and the applicable national laws of France. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Paris, France.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
